RentinBA Terms & Condition

1.- Scope of Applicability

These Terms and Conditions for the Serviced Apartment contract apply to contracts for the renting of apartments from RentinBA to guests including all the services and deliveries performed by RentinBA for the guests. The subletting or reletting of the apartment(s) or any of its room(s) as well as its use for purposes other than accommodation requires the prior explicit approval of RentinBA.
These General Terms and Conditions apply exclusively. Terms and conditions of the guest only apply if they have been expressly agreed upon in advance.
Disclaimers, Identification and Penalties:

RentinBA Content and User Content License

Subject to your compliance with these Terms, RentinBA grants you a limited, non-exclusive, non-transferable license, solely for personal, non-commercial use, to access and view Content to which you are permitted access.

You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit the Site, Services, or Content, except as expressly permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by RentinBA or its licensors, except for the licenses and rights expressly granted in these Terms.

If you submit User Content to RentinBA through our website, by email or by any other means, you permit us to and we may, in our sole discretion, post, upload, publish, submit or transmit the User Content. By making available User Content to RentinBA, you grant to RentinBA a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, which includes rights to sublicense, use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such User Content on, through, or by means of or to promote or market the Site and Services.

RentinBA does not claim any ownership rights in the User Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit the User Content.
You represent and warrant that:
(i) you either (a) are the sole and exclusive owner of all User Content that you make available to RentinBA, or; (b) you have all rights, licenses, consents and releases that are necessary to grant to RentinBA the rights to the User Content as contemplated under these Terms; and (ii) neither the User Content nor your submission or transmittal of the User Content or RentinBA Collection’s use of the User Content (or any portion thereof) will result in the violation of any applicable law or regulation or infringe upon, misappropriate, or violate a third party’s intellectual property rights of any kind, moral rights, other proprietary rights, or rights of publicity or privacy.

2.- Payment. Method & Time.

RentinBA will provide flexible payment options in order to accommodate the guests need.

The variety of payment options could vary from apartment to apartment and from country to country and there could be a small administrative surcharge ranging between 3% and 7% on top of the billed price. A non-limiting list of payment options is: cash, credit card payment, debit card payment, bank transfer, PayPal, Mercado Pago and other online payment platforms.

RentinBA provides the possibility to pay in different currencies. If the quotation of the rental has been in United States Dollars and the guests chooses to pay in Argentine Pesos, the exchange rate will be that of the Banco Nación de la Argentina, in the “Cotización BIlletes” section, using the “Venta” exchange rate of the payment day or the billing dates, whatever comes first.

If the guest chooses to pay in any other currency that’s not the Argentine Peso or the US Dollar, a fee may be added to the international exchange rate of that currency with the dollar to adjust to market prices in Argentina.

Similarly, third-party payment processors may also use a currency conversion rate for or impose a currency conversion fee on your payment or payout. You acknowledge that none of these currency conversion rates or fees are controlled by or known to RentinBA.

For stays of 3 months or less, full balance is due upon check-in. For longer stays, month-to-month payments can be arranged.

3.- Security Deposit.

Security deposits will be equal to ½ of the monthly rate with a minimum of US$ 300 for short term stay. If the guest is staying for a period of time equal to 3 months or more, the security deposit may be increased up to 1 month of rent. If the guest is entering the property with a pet, the security deposit may be increased up to 100% more.

Once RentinBA receives the deposit, the reservation dates will be blocked and the reservation will be considered confirmed. The only exception for this rule is when overlapping dates are being quoted at the same time for different guests and both guests send the security deposit in the span of 24hs. In this case RentinBA will offer alternative apartment options for the guest to choose from. If the guest doesn’t find any other property of their liking, then RentinBA will proceed to refund the security deposit fully.

After the check-out, the security deposit will be fully refunded in the same currency and in the same way it was received minus any damages to the property that exceed the usual wear and tear.

4.- Seasonality & Pricing.

Due to increased holiday-season demand, a surcharge is added to the rental price for any stay under 40 nights that overlaps Dec. 23 - Jan. 3. The surcharge is 30% for any such stay of 1 to 10 nights, 20% for 11 to 20 nights, and 10% for 21 to 39 nights.

Rates and availability are subject to confirmation.

5.- Taxes.

Value-Added Tax (VAT) or Impuesto al Valor Agregado (IVA), as it called in Argentina, is not included in the published prices on RentinBA’s website and equals to 21%. The main reason is that all tourists are exempt from paying IVA for their accommodation providing the guest complies with the following conditions: (i) Guest is a foreigner with a tourist visa valid for up-to 90 days in the country; (ii) Guest presents his/her passport and Argentine Government stamp; (iii) Payment is performed with an international credit card.

6.- Utilities. WiFi.

Unless otherwise indicated on this page, all utilities (gas, electric, water, cable, etc.) are included in the rates shown on RentinBA’s site. A cap on electricity consumption may be applicable due to an energy conservation policy adopted by RentinBA in accordance with Buenos Aires power grid state.

Wifi Internet is included in every apartment listed on RentinBA’s website.

7.- Penalties.

RentinBA must see that the leased apartments, whether it’s short term bookings or long term bookings are properly taken care off by the guests and because of that, penalties may apply to undesired behavior on the guest(s) behalf. Actions that force RentinBA to incur in avoidable expenses in order to maintain the property’s status quo. Unless both parties expressly agree upon it, the following actions are hereby banned or penalized from any property rented through RentinBA:
Smoking inside the property: All properties are smoke-free properties and smoking inside is forbidden. If cigarette odor is present in the property, RentinBA can charge a fine of up to US$ 100 (one hundred dollars). This amount can increase to up to US$ 200 (two hundred dollars) if the guest continues to smoke inside the property. After two warnings the guest may be deemed as unfit to take care of the property and will have to leave the apartment.
Pets: All animals are banned from entering RentinBA’s apartments unless explicit permission is granted. Fines of up to US$ 100 (one hundred dollars) may apply.
Issues with keys and locks: If the guest loses a key and it needs to be replaced, a fine of up to US$ 50 (fifty dollars) can be charged for the item that needs to be replaced. The amount can increase if the key presents special requirements for its obtention, such as special permit from the building management. In case a guest is locked out of his or her apartment due to its own fault, they will be charged for the man hours and the cost of opening the apartment. If this happens outside of regular business hours a fee of US$ 20 (twenty dollars) will instantly apply. Broken or lost inventory: If any items are lost or damaged, RentinBA will charge the guest the market value of the item plus an administrative surcharge of 15% (fifteen percent).
Uninformed guests: All occupants of the apartment must be informed on beforehand. Once inside the property, any changes in guests and or extra guests for a time period must be informed to RentinBA. If more guests than previously informed are find to be using the property the guest may be asked to leave the property; aggravated if the quantity of guests exceeds the amount of beds in the property. Security Deposit: If any of the previous scenarios applies, RentinBA can collect the payment from the guest security deposit or credit card or the guest may pay RentinBA directly.

8.- Cancellation Policies.

The following fees apply to all bookings and or reservations made with RentinBA. but can be left aside if the circumstances abide; all cases will be specially reviewed before any decision is made.
Booking Cancellation. Once we receive a security deposit, the reservation is confirmed, and we turn away bookings from other interested tenants for the reserved dates. Because of this, security deposits are completely non-refundable upon cancellation. However, any prepayments of the rent itself are fully refundable upon any cancellation made at least 48 hours prior to check-in.
No shows from guests who fail to inform RentinBA about any changes in their reservation will be considered a booking cancellation.
If the reservation is canceled with 45 days or more in advance to the check-in date, then the security deposit is fully refundable.
Last minute change of arrival date: If the guest arrival date is changed within two weeks to the check-in date, the original rent is still due by the guest.
Shortened stay: The guest may shorten their reservation but RentinBA cannot guarantee rent money will be returned to the guest for reservations of 3 months or less. Given the broad scenarios that can be presented, all cases will be reviewed individually.

Special terms will apply to partners and corporate clients.

9.- Extension.

If the guest wishes to extend a reservation after the check-in date it will be subject to availability and new rates may apply. The rent amount must be paid when solicited and confirmed. Any extension request will be given priority over other requests with overlapping dates of stay.

10. Maintenance.

Improvements and Maintenance. Owner shall complete any and all maintenance or improvements required to maintain the Minimum Standard and shall complete them as soon as is reasonably possible.

11.- Minimum Stay.

RentinBA general policy is to have a minimum stay of 3 nights and the nightly rate is published in accordance to this policy. Exemptions may be given to guests on occasional basis and the nightly fee may increase.

Other properties may have a minimum stay greater than this due to building rules or owner’s special requests.

12. Services and special requests.

RentinBA will provide basic hygiene products, including towels, shampoo and conditioner, toilet paper and soap in every rental. Additional services including cribs, extra beds and welcome baskets are available upon request and for an additional cost.

13.- Unavailability.

If an Accommodation that has already been requested or booked by the Guest becomes unavailable for any reason, or if a defect of any sort is discovered during the Guest’s stay, RentinBA will notify the Guest that made the Reservation and make all commercially reasonable efforts to provide an alternative Accommodation of a similar price and with similar features for the requested dates until the defect is resolved or the Reservation contract terminates.

If the Guest is unsatisfied with the alternative Accommodation offered as a result of unavailability, a problem or a defect, he or she may choose to: (a) cancel the Reservation and receive full reimbursement of the Initial Reservation Payment and the Reservation Balance (if any) paid to RentinBA if the unavailability, problem or defect is discovered before or during check-in; or (b) receive a reimbursement proportional to the length of the unused Reservation term if a problem or defect is discovered during the Guest’s stay.

RentinBA will not reimburse or relocate Guests should issues unrelated to the accommodation and/or beyond our control occur. These include unsolicited street noise, constructions, maintenance or repair (including within the building of the Accommodation itself), temporary malfunctioning of elevators, issues with the internet (including interruptions or slow speeds), unforseen acts of God, or any other uncontrollable events.

Nevertheless, RentinBA will make commercially reasonable efforts to resolve or minimize the situation. RentinBA cannot and does not guarantee that its eventual resolution of the situation will not increase expenses for the Guest, including increased Reservation Payments or other expenditures. A Guest’s exclusive remedies against RentinBA in any of the above-described events are to: (i) accept RentinBA Collection’s alternative Accommodation arrangements or (ii) cancel the remaining portion of the accommodation agreement and receive a reimbursement proportional to the length of the reservation term cancelled.

14.- Flight information.

Our Guest Experience staff will contact the Guest upon confirmation of Reservation to request his/her flight information. This information is necessary for RentinBA to monitor the Guest’s flight and take any and all appropriate measures related to scheduling and/or rescheduling the check-in process. If the Guest misses or changes his or her flight or any other changes to the Guest’s flight information occur, the Guest must inform RentinBA as soon as practicable.

15.- Special requests.

If the Guest should have any special requests or require any additional services, they must inform RentinBA before or at the time of making the reservation so as to ensure that these needs can be met. RentinBA will not be held responsible for the lack of any request or service that was neither requested with anticipation nor part of the given inventory or service list of the Accommodation reserved.

16.- Payment Errors.

RentinBA offers flexible payment options so in case of a payment processing error that’s not fault of RentinBA, it’s the guests responsibility to offer alternative payments. There will be a 48hs tolerance to confirm rent payment before considering this situation as a booking cancellation.

The Site, Services, and Content are protected by copyright, trademark and other laws of the United States, Argentina and foreign countries. You acknowledge and agree that the Site, the Content and the Services, including all associated intellectual property rights, are the exclusive property of RentinBA and its licensors. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site, Services, or Content.

You acknowledge and agree that RentinBA is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources, products or services on or available from such websites or resources.
